Terms of Service

These Terms govern your use of the Plomly app for Shopify ("the App") operated by Plomly ("Plomly", "we", "us"). By installing or using the App, you ("Merchant", "you") agree to these Terms. If you do not agree, do not install the App.
1. The service
Plomly provides a measurement calculator widget and AI shopping assistant for Shopify stores. It is designed for stores selling products by area, volume, length, or quantity (tile, paint, wallpaper, flooring, grass, concrete, etc.).
Features depend on your plan and include: a configurable calculator on product pages, project planner (cross-product recommendations), AI chat assistant, onboarding wizard, and analytics.
2. Plans and billing
Plomly offers three plans:
- Free: limited to 500 calculations/month and 10 configured products.
- Pro ($14.99/month): unlimited calculations, all products configured, no AI features.
- Premium ($34.99/month): everything in Pro, plus project planner and AI chat assistant.
All paid plans are billed through Shopify's Recurring Application Charges (Billing API). Plomly does not handle payments directly. Charges appear on your Shopify invoice.
Trial periods, when offered, are stated at the time of subscription. After the trial, you will be billed automatically unless you cancel.
You may cancel at any time. Cancellation takes effect at the end of your current billing period; no refunds are issued for unused time.
3. Acceptable use
You agree NOT to:
- Use the App to violate any law or Shopify's Terms of Service
- Resell or redistribute Plomly as your own product
- Attempt to reverse-engineer the App or access source code beyond what is publicly available
- Abuse the AI features to generate harmful, illegal, or misleading content
- Use the App for products outside its intended scope in ways that result in significantly inaccurate calculations being shown to customers
We reserve the right to suspend accounts that violate these terms.
4. Your data and content
You retain ownership of all data you upload to or generate within the App (product configs, customer chat logs you've enabled, etc.). We process this data as your service provider, in accordance with our Privacy Policy.
You grant Plomly a limited license to access and process your data solely to provide the App's functionality. We do not use your data for any other purpose.
If you uninstall the App, your data is deleted within 48 hours per Shopify's GDPR requirements.
5. AI assistant disclaimer
The AI features (Premium plan) use Anthropic's Claude model. While we tune the AI to give accurate quantity recommendations based on your catalog, AI output is probabilistic and may occasionally be inaccurate.
You and your customers are responsible for verifying material quantities before purchasing. Plomly is not liable for material shortages, surpluses, or project outcomes resulting from AI-generated recommendations.
The AI is configured to refuse to invent products that are not in your catalog. If it does so anyway, please report it to contact@plomly.com.
6. Availability and support
Plomly aims for 99% uptime but does not guarantee uninterrupted service. The App may be unavailable during maintenance windows, due to issues at upstream providers (Shopify, Anthropic, Resend), or during incidents.
Support is provided via email at contact@plomly.com. We aim to respond within 2 business days. Premium plan subscribers receive priority support.
7. Termination
You may terminate this agreement at any time by uninstalling the App from your Shopify store.
We may terminate or suspend your access:
- If you violate these Terms
- If your Shopify account is closed or suspended
- If your subscription is cancelled or fails repeatedly
- With 30 days' notice if we discontinue the App entirely
8. Limitation of liability
To the maximum extent permitted by law:
- Plomly is provided "as is" without warranties of any kind, express or implied.
- Our total liability to you for any claim arising out of or relating to the App shall not exceed the amount you paid us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost sales, lost data, or business interruption.
9. Changes to terms
We may update these Terms as the App evolves. Material changes will be announced via email to active merchants at least 14 days before taking effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of Spain. Any dispute shall be resolved in the courts of Madrid, Spain, unless EU consumer protection rules apply to your jurisdiction and grant you additional rights.
